These Terms govern your use of PulsePoint. By creating an account or using the service, the person accepting agrees on behalf of their organisation. If you don't agree, don't use the service.
1 The agreement
This is a contract between FirstHR Services Pvt. Ltd. and the organisation you represent ("Customer"). You confirm you're authorised to bind that organisation.
2 Your account
- You're responsible for the accuracy of your roster and for keeping login credentials secure.
- You must have a lawful basis to add each employee and to survey them, and to provide them the required privacy notice.
- You won't use PulsePoint to harass, surveil individuals, or attempt to de-anonymise responses.
Anonymity is not optional. Any attempt to identify individual respondents — by shrinking segments, cross-referencing timing, or otherwise — is a material breach and grounds for immediate suspension.
3 Plans, billing & taxes
Paid plans are billed by company-size tier as shown on our pricing page, monthly in advance. All fees are exclusive of GST (18%), which we add as required. Payments are collected via Razorpay (UPI, net banking, or card). Failure to pay may result in suspension after a grace period. Cancellations and refunds are governed by our Refund & Cancellation Policy.
4 Acceptable use
Don't reverse-engineer, resell, or overload the service; don't upload unlawful content or malware; don't use PulsePoint to make automated employment decisions that materially affect individuals without human review.
5 Data ownership
You own your data. We own the platform. You grant us a limited licence to process your data solely to provide and improve the service, as described in the Privacy Policy and DPA. Aggregated, fully anonymised benchmarks may be used to improve product features.
6 Service levels & availability
We aim for high availability but the service is provided "as is" for free tiers. Paid plans target 99.5% monthly uptime, excluding scheduled maintenance (notified in advance) and events outside our reasonable control.
7 Warranties & liability
To the maximum extent permitted by law, PulsePoint's aggregate liability in any 12-month period is limited to the fees you paid us in that period. We're not liable for indirect or consequential losses, including employment decisions made using our insights.
8 Suspension & termination
You may cancel anytime from Settings → Billing. We may suspend or terminate for material breach, non-payment, or unlawful use. On termination we'll make your data available for export for 30 days, then delete it per our retention schedule.
9 Governing law
These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra have exclusive jurisdiction, subject to any mandatory consumer-protection rights.
